A federal judge denied a Nevada college student’s request for an emergency court order that would’ve allowed the 18-year-old to register for classes at the University of Nevada, Reno.
Jacob Gold sought the order as part of his lawsuit questioning the constitutionality of the school’s mandatory vaccination policy, according to the Associated Press.
Gold said he developed immunity from COVID-19 following a previous bout.
He asserted that it is statistically impossible for a vaccine to work for him, AP reported.
However, Judge James V. Selna, who was reassigned to the case earlier this month, refused to grant Gold an order on grounds the plaintiff failed to establish a fundamental constitutional right to refuse vaccination.
“This far outweighs any harm Gold may face in choosing between receiving a medically approved vaccination or receiving his education in an alternative manner,” Selna said, AP reported Dec. 9.
The university's policy, which went into effect in August, stated that “all undergraduate and graduate students are required to provide documentation of a completed vaccination series against COVID-19 before enrolling for the Spring 2022 semester.”
“This means students must receive both doses of the Pfizer-BioNTech or Moderna vaccine, or the single dose of Johnson & Johnson (Janssen) COVID-19 vaccine before they can enroll when enrollment times begin on Nov. 1,” the university said. “As with all other vaccinations that are required to attend the University, students will not be allowed to enroll in Spring 2022 classes (or future classes) until documentation of completed COVID-19 vaccination series or approved medical or religious exemption is on file.”
Gold’s suit implicated the university, Gov. Steve Sisolak and others, the AP reported Nov. 18.
AP also reported that the student is represented by former boxer turned Republican Nevada gubernatorial candidate Joey Gilbert.
